General Terms & Conditions

The following are certain general terms and conditions governing advertising published in any and all of Fun2Raise Marketing & Events’ (“Publisher”) publications.

• An advertiser running an advertisement in one of our publications will automatically run in the print and digital edition unless the advertiser explicitly, in writing, opts-out of running in the digital edition, either on the ad agreement or via email, no later than the ad close date.

• Advertisers may not cancel orders for, or make changes to, advertising after the closing dates of the publication.

• Publisher is not responsible for errors or omissions in any advertising materials provided by the advertiser or its agency (including errors in key numbers) or for changes made after closing dates.

• Publisher may reject or cancel any advertising for any reason at any time. Advertisements simulating the publication’s editorial material in appearance or style or that are not immediately identifiable as advertisements are not acceptable.

• Your advertising space will be featured in the promotional collateral material as detailed in this agreement. Publisher will provide all necessary and reasonable marketing, consulting, graphic layout and design services at no extra charge. Publisher will make all decisions regarding advertisement placement.

• Publisher has the right to insert the advertising anywhere in the publication at its discretion, and any condition on contracts, orders or copy instructions involving the placement of advertising within an issue of the publication (such as page location, competitive separation or placement facing editorial copy) will be treated as a positioning request only and cannot be guaranteed.

• Publisher will attempt to keep the same running order of advertisements in the digital edition as they appeared in the print edition, but the Publisher does not make any adjacency guarantees or other promises regarding competitive separation of the positioning of any advertisements in the digital edition. Publisher’s inability or failure to comply with any condition shall not relieve the agency or advertiser of the obligation to pay for the advertising.

• Publisher will provide you with the opportunity to proof and approve your advertisement. You agree to approve your advertisement, or request revisions, within 48 hours following receipt of the advertisement proof. If we do not receive your approval or revision request within 48 hours, you agree that you have approved the advertisement. Publisher is not responsible for any advertisement content errors after we receive your written approval.

• Advertisements created by the Publisher will remain our property and cannot be reproduced in any form without our permission. If you provide us with photos for your advertisement, you warrant that you are the owner of the copyright in all photos submitted for reproductions by us or you have otherwise secured the right to reproduce the photos. You will indemnify us from any breach of this warranty.

• You acknowledge that all sales are final and that we will not be liable for refunds. Unless alternate payment arrangements are made, payment is due within 15 days of the signing of this agreement.

• We will not begin ad design until payment is received. In event of nonpayment, we may refer any account to a collection agency or attorney, and you agree to pay a collection fee of 18% APR each month payment is overdue and all costs and expenses of collection on a delinquent account, including reasonable attorneys’ fees.

• Should you request a copy/copies of advertisements published by us for other promotions, we will charge an additional fee beyond the initial advertising costs to cover the time in preparing the new advertisement according to your specifications.

• Our liability for any action arising under this agreement, including but not limited to an error in an advertisement, will not exceed the cost of running a replacement advertisement in future promotional material.

• Publisher does not provide any printed samples of Calendars or Directories.

• Publisher reserves the right to modify these terms and conditions at any time.
